{"id":1427,"date":"2026-08-22T10:36:51","date_gmt":"2026-08-22T08:36:51","guid":{"rendered":"https:\/\/bravasun.com\/?page_id=1427"},"modified":"2026-08-22T10:36:51","modified_gmt":"2026-08-22T08:36:51","slug":"general-and-specific-terms-and-conditions-of-sale","status":"publish","type":"page","link":"https:\/\/bravasun.com\/en\/conditions-generales-et-particulieres-de-vente\/","title":{"rendered":"General and specific conditions of sale"},"content":{"rendered":"<h2 class=\"wp-block-heading\">SPECIAL TERMS AND CONDITIONS OF SALE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>APPLICABLE AS OF MAY 2, 2023<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By accepting the travel quote, the client acknowledges having read and explicitly accepted BRAVASUN's General and Special Terms and Conditions of Sale, as well as the detailed descriptions of the trip attached to the quote.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">ADMINISTRATIVE PROCEDURES<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">BRAVASUN informs French clients as well as nationals of the European Union and the European Economic Area of the administrative and health procedures to be followed when crossing borders. In the absence of any indication to the contrary from the client to BRAVASUN, French nationality is assumed. Foreign nationals are invited to contact their consulate to inquire about the border crossing conditions for the country concerned by the travel package.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For any air travel service, it is imperative that the traveler presents a copy of their passport.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should be emphasized that the French identity card remains valid for only 10 years within the European Union, as many countries do not accept card validity extensions. The traveler is strictly required to provide a copy of their passport for any air or land travel, and to comply with the health measures in force at their destination and\/or related to any pandemic situation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">RESPONSIBILITIES<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As a travel service provider, our liability may be limited by the implementation of international conventions, particularly with regard to air transport, such as the Warsaw Convention of October 12, 1929, as amended, and the Montreal Convention of May 28, 1999.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BRAVASUN declines all responsibility in the event of failure to register the customer in the following situations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Delay caused by pre-transit by road, air, or rail chosen by the customer, resulting in the customer's delay or absence at the departure of their trip, for any reason whatsoever, even in the event of force majeure, an unforeseen event, or the responsibility of a third party<\/li>\n\n\n\n<li>Passenger's failure to present the administrative, police, or health documents required for their journey (passport, visa, parental authorization for minor children, medical certificate, etc.).<\/li>\n\n\n\n<li>BRAVASUN cannot be held liable in the event of a departure cancellation, schedule or itinerary modification, or unavailability of booked services arising from force majeure events within the meaning of French case law, the unforeseeable and external fault of a third party, or the fault of the customer.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">PARTIAL CANCELLATION, MODIFICATION OF SERVICES AND ON-DEMAND SERVICES AT THE CUSTOMER'S REQUEST<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Modification<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">For a confirmed booking, certain modification requests for one or more travelers made before the start of a trip are possible free of charge upon request by the client and written acceptance by BRAVASUN.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nevertheless, no free modifications are possible for the flight and will incur additional fees entirely at the customer's expense, notably for modifying or issuing a new ticket.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the remaining services and activities offered, any modifications that cannot be made free of charge will be possible under the following conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>45 days before departure: a fee of \u20ac65 per person in addition to the cost of any added or modified services.<\/li>\n\n\n\n<li>30 days prior to departure: a fee of \u20ac160 per person in addition to the cost of any added or modified services.<\/li>\n\n\n\n<li>Less than 30 days before departure and after departure: the costs for any modification not authorized by BRAVASUN are entirely the responsibility of the client, with no possibility of a refund for unused services.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Partial cancellation of the group<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of a partial cancellation affecting up to 15 % of the total number of participants:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Up to 90 days before departure: a refund of the amount billed, minus a penalty of 30 % per person.<\/li>\n\n\n\n<li>Up to 45 days before departure: a refund of the amount billed, minus a penalty of 60 % per person.<\/li>\n\n\n\n<li>Less than 45 days before departure: no refund will be granted.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If more than 15 % of the participants cancel, no refunds will be issued.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">PRICE<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed rates are in euros \u20ac. VAT not applicable \u2013 special scheme for travel agencies (art. 266 CGI and art. 306 of Directive 2006\/112\/EC)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are indivisible or non-fractionable; any waiver of services included in the package or trip interruption by the client (in case of hospitalization or early repatriation) will not be refundable, unless specific insurance has been purchased. Unless otherwise indicated in the travel contract, the rates do not cover administrative fees related to visas and passports, optional insurance for cancellation, assistance, baggage, and personal expenses, tips, and any other expenses that are not clearly indicated and included in the quote package.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">AIR TRANSPORT<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The consequences of accidents or incidents during air transport are defined by the amended Warsaw Convention of 1929 and the Montreal Convention of 1999. These conventions establish limitations of liability that could be advantageous to us as a travel agency, pursuant to Article L211-16 of the Tourism Code. The conditions of carriage are included with the tickets, and schedules will be communicated in due course before the trip, and may be modified by the airline even after confirmation. No refunds will be issued for unused seats. Air delays, caused for example by strikes or technical incidents, are governed by European Regulation No. 261\/2004. Airport changes or unforeseen stopovers may be decided by the airline without notice. The list of airlines used complies with the provisions of the Tourism Code.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">BAGGAGE<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the field of air transport, the liability of airlines is limited or excluded in the event of loss, damage, or delay of baggage, in accordance with the Warsaw and Montreal Conventions. These conventions may also apply to BRAVASUN if its liability is incurred. Any claim must be made immediately by the customer in person with the air transport services at the airport as soon as the damage is discovered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No baggage insurance is included in the service rates offered by BRAVASUN.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BRAVASUN accepts no liability in the event of loss, theft of, or damage to luggage or personal effects during the trip. In the event of an incident, customers are advised to report the facts to the relevant local authorities and file a complaint.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is essential to note that for customers undergoing medical treatment, it is recommended to keep medications in the cabin in a carry-on bag along with the prescriptions, and not to put them in checked luggage. In addition, it is advisable to keep valuables in the cabin as long as they are permitted in the cabin and comply with the weight limits set by the carrier.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">RECLAMATION<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Any complaint concerning one of the services included in our packages, relating to the course of your trip, must be submitted in writing within fifteen days following your return. Please send your complaint by e-mail, accompanied by the appropriate supporting documents, to the following address: <a href=\"mailto:gestion@bravasun.com\">gestion@bravasun.com<\/a><\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">TERMS AND CONDITIONS OF SALE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>APPLICABLE AS OF 05\/02\/2023<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 1: PURPOSE AND SCOPE<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These General Conditions of Sale (GCS) constitute the basis of commercial negotiations and are systematically sent or given to each buyer to enable them to place an order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The general terms and conditions of sale described below detail the rights and obligations of the company BRAVASUN and its client in connection with the sale of the following services:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sales, travel planning and organization, corporate seminars, motivation and team-building events.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any acceptance of the quote\/purchase order must include the clause \u00abI acknowledge that I have read and I accept the attached general terms and conditions of sale\u00bb, which implies the buyer's unreserved acceptance of these general terms and conditions of sale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 2: PRICE<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The prices of the services sold are those in effect on the day the order is placed. They are denominated in euros.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are firm and final. BRAVASUN undertakes to invoice the services ordered at the prices indicated when the order is registered.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 3: REBATES AND DISCOUNTS<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed rates include the discounts and rebates that BRAVASUN may grant given its results or the assumption of certain services by the buyer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 4: DISCOUNT<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">No cash discount will be granted for early payment.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 5: PAYMENT TERMS<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Payment for orders is made by bank transfer:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>40% when ordering more than 60 days before departure:<\/li>\n\n\n\n<li>The balance must be paid in full 60 days before departure.<\/li>\n\n\n\n<li>With less than 60 days to go before departure, the 100% is on order.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 6: LATE PAYMENT<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of total or partial default of payment in accordance with the payment schedule, the buyer must pay the company BRAVASUN a late payment penalty equal to three times the legal interest rate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicable statutory interest rate is the one in effect on the date of delivery of the services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This penalty is calculated on the total amount including tax of the sum remaining due, and runs from the due date of the price without any prior formal notice being necessary.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 8: TERMINATION CLAUSE<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If within fifteen days following the implementation of the \u201cLate payment\u201d clause, the buyer has not paid the remaining sums due, the sale shall be automatically canceled and may give rise to the award of damages to BRAVASUN.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 9: ORDER CANCELLATION<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The order is confirmed as soon as the purchase order is signed by the Seller or the latter sends a confirmation email for the order, thereby making the order firm and final.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, no order may be modified or canceled without prior written agreement between the Seller and the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of cancellation of a confirmed order by the Client, for any reason whatsoever, and without prejudice to any additional damages and interest:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The deposit paid by the Customer upon ordering shall remain rightfully acquired by the Vendor and shall not give rise to any refund.<\/li>\n\n\n\n<li>Less than 60 days before departure, the total price will be due to the Vendor and invoiced to the Client.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">CLAUSE NO. 10: FORCE MAJEURE<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">BRAVASUN's liability cannot be invoked if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale arises from a case of force majeure.
